1 § The person in another state is suspected, accused or convicted of where straffbe law
d deed and staying in this country may be decided by the Government
extradited to the State in accordance with the provisions of this Act.
Team one will not apply if one team ( 1959:254 ) concerning extradition to Denmark, Finland, Iceland and Norway, or team a ( 200 3: 1156 ) on surrender from Sweden under a European arrest warrant applies in relation to the other state. Act (200 3: 1158).

1 § The person in another state is suspected, accused or convicted of where straffbe law
d deed and staying in this country may be decided by the Government
extradited to the State in accordance with the provisions of this Act.
Team one will not apply if one team ( 200 3: 1156 ) on surrender from Sweden under a European arrest warrant, or law a ( 2011:1165 ) on surrender from Sweden according to a Nordic arrest warrant is applicable in relation to the other state. Teams (2011: 1166).

4 § Extradition may be granted only if the act for which extradition is sought equivalent offense for which under Swedish law provides imprisonment for one year or more. Has the
person in the requesting state convicted of the offense, he may be
extradited only if the sentence is less than imprisonment for four
months or other disposal of the institution during the same time.
Should disclosure be made to another state for the act referred to in the first paragraph , get extradition to the State but also granted for another act corresponding offense under Swedish law.
Does the person in the requesting state has been sentenced to common sanction for an act referred to in the first paragraph , first sentence, and another act that corresponds to an offense under Swedish law,

provisions of an international agreement that is in force between Sweden
and the applicant State.
This does not preclude that, if the offense also constitutes an offense
for which extradition otherwise get done, extradite the person for that

§ 6 Extradition shall not be granted for a political offense.

9 § If
the person is requested extradition convicted of the offense in the
foreign State, extradition may not be granted, unless the judgment is
supported by the investigation, nor otherwise give rise to serious
objection.
If the ruling on the act is not granted in the foreign state, the extradition request is based on the decision to arrest, issued by the competent authority of the foreign state. In terms of offense for which extradition can be made according to § 4, second paragraph , may, however, request based on other evidence. The petition may not be granted, with less probable reasons are that the person committed the act.
By
agreement with a foreign state may be determined, in relation to the

11 §
The person in this country is prosecuted for any crime for which
provides for imprisonment, or by a judgment against him to undergo
imprisonment or otherwise disposed of in institutions, may not be

In the cases referred to in 5 or 6 §

12 a § As follows from an international agreement that is binding on Sweden, the person extradited, in addition to those required by § 12 first paragraph 1 , prosecuted or punished for any crime he or she committed before the extradition, if he or she has consented to it. Teams (200 3: 1158).
1:03 a.m. §

§ 14 A request for extradition shall be made in writing. It may be transmitted by fax or by agreement in the case, otherwise. The petition shall be filed with the Justice Department.

§ 15 Before the government issues a decision on the request, the opinion delivered by riksåk law breaker. § 21 When extradition is granted the Government may order any taken in the bes law

Coercive measures pending a request for extradition | |
2:03 a.m. § The person in the foreign country is suspected, accused or convicted of crimes, which under this Act

Have a request for extradition of the person arrested or subject to a travel ban, notification is not made in accordance with the second paragraph appointed time, the person arrested shall be released or the travel ban, notification lifted. The same applies when an extradition request is refused under § 15 .
If the arrested person not otherwise released, shall produce avlåtas to

§ 24
Notwithstanding the conditions set for the extradition own government

§ 25

§ 26 The head of the Justice Department may grant that he who by a state extradited to another state must be passed through the kingdom, unless he is a Swedish citizen and there are no other compelling reasons against it. Production will be given to the Ministry of Justice.
Consent may be given to a Swedish citizen executed through Empire, the obstacles would not have existed for handing him or her to the receiving State in 2 or 4 § teams one ( 1959:254 ) concerning extradition to Denmark, Finland, Iceland and Norway.
If permission has been granted in accordance with the first or second paragraph of the police authority may, if it is necessary for the transport to be carried through, seize and take into custody the person extradited, however, more than forty-eight hours.

26 a § Have
extradition to Sweden for trial in this country, on condition that the
person extradited later returned to the other state, the police
authority in the place where the trial has taken place to ensure that the person extradited back.

26 b § If at a transport referred to in § 26
is an unplanned stopover in Sweden, the condition for carriage under
that section may be requested, in the event that the shipment does not
resume within twenty-four hours from landing. Permission to transport shall be requested within ninety-six hours from landing.
The police authority may, if it is necessary for the transport to be carried through, seize and take into custody the person extradited, but until then a request for a permit to transport has been examined. If authorization to transport is not claimed within the period specified in the first paragraph , the person shall be released immediately.
If permission for transport announced, then the provisions of § 26 third paragraph . The period shall be counted from the state announced.
In the case of Swedish nationals, the provisions of the second and third paragraphs only in the circumstances specified in § 26, second paragraph .
When there is someone who disclosed to a Member State of the European Union, applied Chapter 8. § 2 teams one ( 200 3: 1156 ) on surrender from Sweden under a European arrest warrant instead of this section. Teams (2005:50 3).

Äldre bestämmelser gäller i förhållande till en stat som den 1 januari 2004 var medlem i Europeiska unionen och som när ärendet inleds inte har genom fört rådets rambeslut 2002/584/RIF av den 1 3 juni 2002 om en europeisk arresteringsorder och överlämnande mellan medlemsstaterna1 3 , dock endast om ärendet har inletts före den 1 januari 2005.
